Introduction This Terms of Service (the "Agreement") is a legal agreement between you (the "User") and VersaDev, the operator of the Discord bots (the "Bot"). By accessing or using our bots, you acknowledge that you have read, understood, and agree to be bound by this Agreement and the accompanying Privacy Policy. If you do not agree to these terms, you are not authorized to use our bots.
Modification of Terms
We reserve the right to modify this Agreement at any time. If we make a material change to this Agreement, we will provide notice to you through our bots or by other means. By continuing to use our bots after those changes become effective, you agree to be bound by the revised Agreement.
Usage Restrictions
Our bots are provided for your personal, non-commercial use only. You may not use our bots for any illegal or unauthorized purpose. You must not, in the use of our bots, violate any laws in your jurisdiction, including but not limited to copyright laws.
User Content
Our bots may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, and videos (collectively, "User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through our bots. By making any User Content available through our bots, you grant to us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit such User Content in connection with our bots and our business, including without limitation for promoting and redistributing part or all of our bots (and derivative works thereof) in any media formats and through any media channels. You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, releases, and permissions necessary to grant the rights granted in this Agreement, and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor our use of the User Content as permitted herein will infringe, misappropriate or violate a third party's patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
Payment
Our bots offer premium features that can be purchased for a monthly fee of $4.99, $11.99, or $29.99. By purchasing premium features, you agree to pay the applicable fees and any related taxes.
Termination
We may, at any time and for any reason, terminate or suspend all or a portion of our bots, or your use of all or a portion of our bots, with or without notice and with or without cause. We shall not be liable to you or any third party for any termination or suspension of our bots or your use of our bots.
Disclaimer of Warranties
Our bots are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of our bots or the information, content, materials, or products included on our bots. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
You acknowledge and agree that we shall not be liable for any damages arising from the use of our bots or the inability to use our bots, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Indemnification
You agree to indemnify and hold us and our affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User Content you make available through our bots, your use of our bots, your violation of this Agreement, or your violation of any rights of another.
Miscellaneous
This Agreement constitutes the entire agreement between you and us regarding the use of our bots. The failure of us to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
